1. Introduction

1.1 Please read these terms and conditions of use ("Terms") carefully before using this site or downloading anything from it. By using the site, you are agreeing to these terms and conditions. If you do not agree with any of these terms and conditions, please exit this site now.

1.2 We may make changes to these Terms at any time. We will let you know what these changes are by posting them to this page, but it is your responsibility as a user to make sure that you are aware of them, by checking for any changes on a regular basis. Changes will become effective as soon as they are posted. If you continue to use our site after the posting of changes to these Terms, it means that you accept any such changes.

2. Copyright

2.1 The contents of this site are the property of Smart Aspirations Limited (us, we, our) and are protected by UK and International copyright laws. These contents include but are not limited to the following: web site design, graphics, text, visual clips, logos and button icons, including the selection and arrangement thereof.

2.2 Portions of this website may be copied electronically or printed in hard copy for the purpose of placing an order with geniass.co.uk. Any other use of this website, without the prior written permission of Express Gifts Limited, is strictly prohibited. The following are therefore expressly forbidden unless written consent has been given by Smart Aspirations Limited: reproduction for any other purpose than those referred to above, modification, distribution, transmission, broadcast republication, downloading or uploading of any part of this website. ALL RIGHTS RESERVED.

3. Payment

3.1 Full payment is required at the time of order select 'proforma invoice', in which case your establishment will be sent a proforma invoice. Goods will only be shipped once full payment has been taken and verified.

3.2 Payment may be made online using Paypal. If you wish to pay by check, please select the 'pay by cheque' option on ordering. You will receive confirmation of your order via email asking you to send a cheque made payable to Smart Aspirations Ltd at 43, Old Road, Tiverton, Devon. EX16 4HL. 4. Tax Charges

4.1 VAT is included at the standard rate. Should you require a VAT receipt for your order please request this by e-mail and quote your order number.

4.2 If your order is to be exported to EU countries, the products are subject to UK Value Added Tax (VAT) charged at 15.0%. If you are within the EU and the goods are to be exported to a destination outside of the UK, sales will be zero rated if you supply an EU VAT Number. Exports to countries outside the EU are zero rated for VAT.

5. Stock Levels

5.1 We try to keep good stocks of all our products, however, there are occasions when demand exceeds supply. If we are out of stock of any of the products on your order, we will telephone you within 2 working days of placing the order to inform you. Your options will be to wait until new stock arrives, to accept a substitute (if there is a substitute) or to cancel your order (please see Canceling Your Order below). If you would like us to send out the products on your order that are available we are happy to do this; the remaining product/s will be dispatched when we receive new stock at no extra charge.

6. Order Confirmation

6.1 Shortly after you have placed your order on line, you will receive an order confirmation from us by email. The confirmation will include the following information:

• Smart Aspirations' address & contact details
• The products that you have ordered and your order number
• The prices including VAT
• The delivery charge including VAT
• Your payment status
• Information about the right to a 'cooling off' period and how to pursue this

7. Shipping and Handling

7.1 Orders are shipped depending on size and weight. Orders of the Geniass^® Game or the 'Complete Revision Pack' will be sent via Business Post at a charge of £6.50 p&p. All other orders will be sent via Royal Mail 1st class post at a charge of £2.00 p&p for individual and packs of question cards with 'additional extras' charged at £1.00 p&p with the exception of the game boards which are charged at £1.50 p&p.

7.2 Orders with a value of over £100 are free of delivery charges.

7.3 All charges are inclusive of VAT at 15.0%, apply to mainland Britain only and are valid until 31st August 2009. For delivery to other areas, please contact us via email jayne@geniass.co.uk to discuss the cost of and time for delivery before ordering. We will need to know what you are planning to order to enable us to gain an accurate quotation.

7.4 All packages sent using Business Post will require a signature on delivery. If no one is available when Business Post tried to deliver the package you may need to collect it from the local Business Post depot - a card will be left with instructions on what you need to do. If you are happy for it to be left somewhere in the event of no one being home, please include instructions on where to leave it upon ordering. It is important that upon signing your write on the couriers consignment note if the package appears damaged or there are items missing. Claims for damage or shortage can only be made if you have recorded this information on the carrier's consignment note, and if your claim is made within 3 days of delivery.

7.5 Please allow 7 working days for delivery after ordering, excluding Bank Holidays and our Christmas & New Year break, subject to stock levels and receipt of full payment. Please note, on rare occasions exceptional circumstances may prevent us from meeting delivery within 7 working days.

7.6 As we do not give you notice of the despatch of your order in advance, it is important that you advise us via email (jayne@geniass.co.uk) if you have not received your order within 7 working days so that we can investigate and rectify this before the statutory deadline expires. After investigation, if we are unable to meet the statutory deadline, we will contact you to offer a revised delivery date after the statutory deadline or substitute products. Should you choose to decline either offer, a full refund (price of products paid and delivery charge) will be offered (see Refund of Cancelled Order below).

8. Cooling Off Period

8.1 You have an unconditional right to cancel your order within the period of 7 working days after the day you receive your order.

9. Canceling Your Order

9.1 If you wish to cancel your order, we will require written notice (sent by post, fax or email) within 7 working days of the date you received your order. Please note it is your responsibility to take care of the products supplied from the time of delivery to the time of dispatch via a carrier for return to Smart Aspirations Ltd. We can only accept return of goods if they are unused, undamaged and in the original packaging.

9.2 Refunds will be made within 30 days from the goods being received by us, provided that the products can be sold again as new. A refund for the product price as stated on your invoice, less the charge for collection of the goods if collection was arranged by Smart Aspirations, will be made within this period. If you paid by Paypal, your Paypal account will be refunded, if you paid by cheque a refund will be made in the form of a cheque.

9.3 If your order was cancelled before being dispatched then a refund for the product price and delivery charge will be made within 30 days of receiving written notice of cancellation. Payment will be refunded in the same manner as it was received. This guarantee does not affect your statutory rights as a consumer.

10. Limitation of Liability

10.1 In the event of any claim being made against Smart Aspirations in respect of goods it supplied compensation shall be limited to the replacement of the goods or the contract value.

11. Amendments

11.1 No amendment to these terms and conditions will be accepted unless made in writing and signed by the Director of Smart Aspirations. These Terms and Conditions of sale shall always apply regardless of any terms and conditions of purchase used by the Customer that may state anything to the contrary. No addition to or variation of these Terms and Conditions of Sale will bind Smart Aspirations, unless it is specifically agreed in writing and signed by the director of the firm. No agent or person employed by or under contract with Smart Aspirations has authority to alter or vary in any way these Terms and Conditions of Sale.

12. Force Majeure

12.1 Smart Aspirations will be released from all liability to the Customer if performance of the contract is delayed or prevented by any cause whatsoever beyond it's control.

13. Disputes

13.1 Any dispute arising under these Terms and Conditions shall be determined by English law.

14. Disclaimer

14.1 The Information on this website is intended to be helpful and informative. However, neither Smart Aspirations or any of its employees, agents or sub-contractors make any warranty, expressed or implied, or assume any legal liability or responsibility for the accuracy or completeness of any information contained on this site or any website referred to. Those who access the site or any site referred to should take appropriate steps to verify all such information. Smart Aspirations Ltd cannot be held responsible for the contents of any pages referred to by an external Link.
